Article 1894: The High Court shall not have authority to find nonjusticiable any case duly submitted by Erstavik.

Article 1895: It is hereby recalled that a frequent recurrence to fundamental principles is essential to the perpetuity of free government.

Article 1897:

Articles 1890, 1891, 1894 and 1895 by @Erstavik are declared null and void as they all violate Article 1594.
Articles 1890 and 1891 also violate the rule of ‘one article per post’. This rule is not stated in any article, but is written in the declaration of the establishment (original post) of Constitution II itself.

Article MDCCCXCII (1892) by @Griffindor shall be repealed as it attempts to carry out an impossible task. The mentioned Section 2 of Article X has been already removed in an amendment by Article 1827. Therefore, there is no valid law to be reinstated and reinforced with Article 1892.

Article 1898 : REFERENDUM (3 DAYS)

Seeing that more repealed than article created. This article serve as a solution to equilibrate the ratio. When an article is repealed by these clause of article 1621 :

These article will have 3 days to rectify their article. If they don’t their article is repeal. When it break one of these clause you shall notify them.

Article 1899: Articles 1887 and 1897 are hereby repealed; and all provisions of this Constitution heretofore abrogated or superseded by said Articles are hereby revived and restored by necessary implication.

Article 1900: Article 1899 by @Erstavik is repealed as it does not provide adequate reasoning for the act of repealing (Article 1621).

Cayo would also like to note that Cayo supports @Hamborn’s Article 1898 referendum because:

  1. Article 1612 allows any article to be rescinded ‘if it is deemed to not to be in the interest of the majority of the people’, and it is hard to determine whether or not an article is not in the interest of the majority without a proper survey.
  2. If a new article is too direct in copy of another standing article, it makes it legal, therefore having no problems other than the fact that such an article already exists.

Therefore, @CayonNS would like to encourage Constitution II contributors and other members of this forum to vote Yes.

Article 1901: Any Article may expressly declare that it shall have force and operation notwithstanding any other provision of this Constitution; but no such Article shall come into force except upon the assent of a majority in a referendum duly held.

Article 1902: @CayonNS officially requests @Erstavik to clarify whether or not they are trying to promote and encourage ‘illegal’ articles to be made with Article 1901, with reasoning. ‘Notwithstanding any other provision’ can be instead written as ‘Even though it breaks existing laws’, therefore meaning ‘Even though it is illegal’. Cayo believes that such an article can do no other than negatively affect the Constitution II.

Article 1903: Article 1901 shall be construed, applied, and given effect so as to authorize and empower any Article promulgated, adopted, or otherwise issued pursuant to the authority herein conferred to operate, have force, and take effect notwithstanding, and without regard to, any provision, limitation, restriction, or contrary requirement contained in any other Article of this Constitution, whether enacted prior or subsequent thereto.

The requirement of submission to and approval by referendum is found to constitute a proportionate and deliberative mechanism by which the preservation of the systemic integrity, coherence, and continuity of the constitutional order is reconciled and balanced with due regard for, and deference to, the sovereign right of the people to determine, redefine, and give authoritative expression to their will concerning the content, form, and future development of this Constitution.

Article 1908: Article 1907 is repealed as it violates Article 1594.

Article 1909:

Section 1.
This Article shall apply to and govern any case or controversy in which jurisdiction is not vested in the High Court of the South Pacific or in the Court of the South Pacific for the District of Government Island.

Section 2.
The Supreme Court of the South Pacific is hereby established and shall be the final arbiter of the meaning, interpretation, and application of this Constitution.

The Supreme Court shall further serve as the court of last instance in all cases arising under this Article.

Section 3.
The Supreme Court shall be composed of three Justices.

The Justices shall be chosen by election and shall serve terms of three months, and may be re-elected as provided by law.

Section 4.
The Court of Media, Subversion, Sandwiches & Shitfuckery is hereby constituted as the trial court and court of first instance for all cases arising within the jurisdiction conferred by this Article.

Section 5
The Media, Subversion, Sandwiches & Shitfuckery Court of Appeals is hereby established as the appellate court possessing jurisdiction to hear appeals from the Court of Media, Subversion, Sandwiches & Shitfuckery, subject to further review by the Supreme Court of the South Pacific.

Section 6.
The common law of England, insofar as it is not repugnant to, nor inconsistent with, this Constitution or the laws of the South Pacific, shall be the rule of decision in all courts of the South Pacific.

Article 1910: And thus Article 1907 needs to be redacted.

Article 1911: Article 1910 shall be repealed as it does not provide proper reasons on why Article 1907 should be redacted.

Article 1912: Article 1911 shall be repealed since some nation, I’m not naming names, deleted their article.

Article 1913: Article 1912 is repealed and 1908 made valid again as Article 1908 is necessary for keeping order.
