Supreme Court of the South Pacific


THE SUPREME COURT

The Supreme Court of the South Pacific was established by Article 1909 of the Constitution and serves as the Lampshade Bar and Grill’s apex court. It holds jurisdiction over all matters not within the High Court of the South Pacific or the Court of the South Pacific for the District of Government Island and functions as the final arbiter of the Constitution.

Composition of the Court

The Supreme Court is composed of three justices, each elected to serve three-month terms. Under Article 1909, the Court also oversees the operation of two lower courts:
  1. The Court of Media, Subversion, Sandwiches & Shitfuckery (CMSS&S) – holds original jurisdiction over all cases.
  2. The Media, Subversion, Sandwiches & Shitfuckery Court of Appeals (MSS&SCA) – exercises appellate jurisdiction over decisions from the CMSS&S.

The Supreme Court additionally appoints the Chief Judge of the CMSS&S, who may in turn appoint associate judges at their discretion. The Court of Appeals is staffed by a Chief Judge, a Circuit Justice (who concurrently serves on the Supreme Court), and the Chief Judge of the CMSS&S.

The selection of justices and judges, as well as the courts’ jurisdiction and powers, is governed by Articles 1909 and 2062 of the Constitution.

Initiating a Case

Civil cases: Begin by filing a complaint and summons with the CMSS&S, detailing your grievances, legal basis, and requested relief.

Criminal cases: Are filed with the CMSS&S by information, which must include a statement of the charges. Following filing, an arraignment is scheduled, during which the defendant is formally advised of the charges and enters a plea.

Appeals

All appeals proceed by writ, in accordance with Article 2062 § 4. The ordinary mode of review is by writ of certiorari.

I have to get every last dollar out of my tuition while I still have access through the university library. Westlaw is like $500 a month if you want full access to statutes, cases, and secondary sources. :squinting_face_with_tongue:
