Because of the Communications Act 2017, the president of Valknett is appointed to a three-year term by the Valkyrian Minister of Communications conditional on the approval of the Jarl(skona) of Valkyria, but prospective presidents must meet several qualifications, such as possessing a bachelor's degree related to telecommunications and acquiring approval from an independent panel composed of experts in that field who are appointed by the Attorney General, who themself is appointed by a self-sustaining independent body known as the Judicial Council.

Several provisions in the Valkyrian constitution protect citizens, residents, companies, and other entities within Valkyria against intrusions by the government. Article II, which outlines the basic rights and freedoms of the nation, affirms the right to privacy and dedicates a section on digital rights, which states:

    1. the right to access digital infrastructure without surveillance from the state unless done so after the issuance of a warrant by an impartial judge upon presentation of probable cause that a person in question is using such access to commit criminal offences;
    2. the right to retain control over their personal data, which shall not be shared or sold without voluntary and informed consent;
    3. and the right not to be profiled by an algorithm or artificial intelligence without voluntary and informed consent.

Because of guarantees and protections provided by the constitution, the Valkyrian government does not have a data retention law, nor can it pass one without first amending the constitution, which would require a referendum. In fact, the Constitutional Court ruled in 2021 that this is the only way privacy and digital rights can be altered. The safeguards against data retention in Valkyria are plentiful.
