
New GA Vote - “International War Crimes Convention”

For the record, I am extremely wary about Clause 12: “Medical personnel, medical transport, and exclusively humanitarian medical operations must not be targeted or obstructed unless used beyond their humanitarian function for hostile military-related purposes”.
This effectively allows militaries to attack civilian medical facilities if they suspect their use “beyond their humanitarian function”. It should be obvious why this is a potential issue.
With that being said, the rest of the proposal is sound, and it’s certainly better than having no war crimes resolution at all.
I think this issue has a lot to do with whether the “unless used beyond their function” clause is self-executing or not. At the same time, states would never agree to grant full passage without restrictions and blindly trusting medical personnel are being used as marked.
