Executive Summary

The Barrier Islands Civil Liberties Union (BICLU) is gravely concerned about the repressive response by the Mitallduk government to the ongoing protests in Ta’ana and Med Karazh. What began as peaceful demonstrations against the court martial of five Mitallduk Defense Forces (MDF) soldiers has escalated into widespread unrest partially due to the government’s heavy-handed tactics. This report aims to detail the developments and highlight active areas of concern regarding civil liberties, human rights, and justice.

Background

On April 24, protests erupted in Ta’ana and Med Karazh following the announcement that five MDF soldiers would face court martial for their involvement in the Coastal Crossing shooting incident. Initially, the demonstrations were peaceful, with protesters calling for justice and questioning the government’s handling of the incident. However, tensions escalated as the Mitallduk government deployed riot police and military personnel to contain the protests.

Observations

  1. Excessive Use of Force
    Legal observers noted riot police have used tear gas, rubber bullets, and water cannons to disperse crowds, leading to numerous injuries among protesters and bystanders. Witnesses reported seeing police using batons and other aggressive measures against unarmed protesters.

  2. Mass Arrests
    Hundreds of protesters have been arrested, with reports indicating that many were detained without proper cause or due process. Some individuals claim they were taken into custody simply for being near protest sites. Two BICLU legal observers were detained by Mitalldukish police on Saturday, April 27, and were released with no explanation regarding the cause of the detention just 3 hours later.

  3. Restrictions on Freedom of Assembly
    The Mitallduk government has imposed curfews and restricted public gatherings in key areas, limiting the ability of citizens to assemble and express their views peacefully. These measures have been implemented without proper justification, infringing on basic civil liberties.

  4. Suppression of Media
    Legal observers reported that journalists covering the protests have faced harassment, with some being detained or having their equipment confiscated. This suppression of media freedom raises serious concerns about the government’s commitment to transparency and accountability.

Impact on Civil Liberties and Human Rights

The Mitallduk government’s response to the protests has raised significant concerns about the erosion of civil liberties and human rights in the country. The use of excessive force, arbitrary arrests, and restrictions on freedom of assembly and the press represent a troubling shift towards authoritarianism. Recommendations

BICLU urges the Mitallduk government to:

  • Immediately cease the use of excessive force against protesters and ensure that law enforcement actions are proportionate and justified.

  • Release all individuals detained without cause and ensure that those facing charges are afforded due process.

  • Lift restrictions on public assembly and respect citizens’ right to peacefully protest and express their views.

  • Allow journalists to report freely without fear of harassment or detention.

  • Engage in meaningful dialogue with protesters and address their concerns through democratic means.
